Wills and Probate Fees

Our Wills and Probate services include:

Our prices start from £250.00 plus VAT for a simple single Will, £350.00 plus VAT for simple couples Wills and £350.00 plus VAT for a Lasting Power of Attorney.

Probate Fees

Our fees for Probate work vary depending on the circumstances.

In relation to any tax that might be payable, we are unable at this stage to advise on the amount and would advise you to visit the HMRC website where you can calculate any Inheritance Tax that may be payable.

In cases where there is one beneficiary and one property, the Probate fees are likely to be at the lower end of the range, whereas cases with multiple beneficiaries, properties, bank accounts etc will have increased fees.

Legal Fees for grant of administration only




Legal Fees for Estate administration (When Ellis & Co are instructed by the Executors)

An hourly rate of £235.00 plus VAT per hour

The above estimate is based on the following:

  • There is a valid Will;
  • Whether any executors have died or refuse to act;
  • There is no more than one property;
  • There are no more than 3 bank or building society accounts;
  • There are no other intangible assets;
  • There are no more than 4 beneficiaries;
  • Whether any beneficiaries do not have capacity under the Mental Health Act or a minor;
  • There are no disputes between beneficiaries on the vision of assets. If disputes arise this will lead to an increase of costs;
  • Whether there are any trusts in the Will;
  • There is no inheritance tax payable and the executors do not need to submit a full account to HMRC;
  • There are no claims made against the estate.

Fixed Fee:

Under our fixed fee work we can assist in obtaining the Grant of Probate and collecting and distributing assets.


Fixed Legal Fees to include the obtaining of the grant.




For this fee you will have a dedicated, experienced Probate Solicitor who will identify the legally appointed executors, identify the type of Probate application you need, complete the application and any necessary HMRC forms, draft a Legal Oath, make the application to the Probate Court and obtain Probate and provide you with two copies of the same.

We are able to offer a fixed fee for the administration of an estate, however this does depend on how complex the estate is and any costs will be agreed in writing with you, before we start the work.


There are some disbursements that are payable to third parties, such as Court fees. To help your matter proceed quickly and efficiently, we deal with these payments on your behalf.

Additional Costs:

There are likely to be additional costs if there is no Will or if the estate consists of any share holdings (Stocks and Bonds) there is likely to be an additional cost. As the cost ranges significantly depending on how the estate is to be handled, we will discuss any additional costs with you.

If additional copies of the Grant of Probate are required, these will be charged at £1.50 per copy or per asset.

If the Estate is subject to Inheritance Tax or there is a need to complete the long Inheritance Tax return then our Fixed Fee will increase from £750.00 plus VAT to £1,200.00 plus VAT. If you have instructed us to deal with the whole of the Estate Administration then this is likely to incur a further 3-4 hours of work.

Any fees relating to the selling or transferring of a property are not included in any of the above cost estimates. If conveyancing services are required we will provide you with a quote for this work.
